HostGTPro: Terms of Service

Welcome to HostGTPro (“we,” “us,” “our,” or “Company”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and HostGTPro governing your access to and use of our Website at hostgtpro.com (the “Website”), our web hosting services, domain registration and transfer services, SSL certificates, email services, and any other related products or services (collectively, the “Services”).

By accessing the Website, creating an account, placing an order, or using any Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Acceptable Use Policy (incorporated herein by reference). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you may not access or use the Services.
We reserve the right to modify these Terms at any time. Changes will be posted on the Website with an updated effective date. Material changes will be notified via email or account dashboard at least 30 days in advance, where feasible. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

1. Definitions

  • “Account” means your HostGTPro user account.
  • “Billing Cycle” means the recurring period (monthly, quarterly, annually, etc.) for which you are charged.
  • “Content” means any data, files, text, images, software, or other materials uploaded or stored by you on our servers.
  • “Money-Back Guarantee Period” means the 30-day money-back guarantee described below.

2. Eligibility and Account Registration

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information immediately. Parents or guardians who believe their child has provided us with personal information should contact us at support@hostgtpro.com.
To access certain Services, you must register for an Account and provide accurate, current, and complete information, including:
  • Your name
  • Email address
  • Billing address
  • Payment details if required
You are responsible for keeping your Account credentials secure and for all activity under your Account. Notify us immediately at support@hostgtpro.com if you suspect unauthorized use.
We reserve the right to refuse service or terminate Accounts at our discretion. As outlined in Section 21 (Export Compliance), we cannot provide Services to individuals or entities located in, or nationals of, any country subject to a U.S. government embargo or designated as a “terrorist supporting” country, or anyone on any U.S. government list of prohibited or restricted parties.

3. Description of Services

We provide shared hosting, reseller hosting, VPS, dedicated servers, domain registration/transfer, and ancillary services. Services are provided “as is,” with commercially reasonable efforts to ensure reliability and performance. We do not guarantee 100% uptime but strive for high availability; any service credits (if offered in specific plans) are outlined in your plan documentation.

4. Service Level Agreement (SLA) and Uptime

While we strive for high availability, we do not guarantee 100% uptime. Scheduled maintenance will be announced in advance when possible. Any service credits or uptime guarantees are outlined in your specific plan documentation. We are not liable for downtime caused by factors beyond our control, including third-party failures, network issues, or force majeure events.

5. 30-Day Money-Back Guarantee

New eligible hosting plans include a 30-day money-back guarantee (“Money-Back Guarantee Period”):
  • Full access to the selected plan features is provided starting from account activation.
  • Payment information is required at signup, and you will be charged for the full Billing Cycle upon activation.
  • The Money-Back Guarantee Period lasts exactly 30 consecutive calendar days from the date of account activation.
  • To request a refund during the Money-Back Guarantee Period, you must open a ticket from inside the Client Area or email billing@hostgtpro.com within 30 consecutive days of account activation.
  • Refund requests will be processed within five to seven business days of approval.
  • If you request a refund during the Money-Back Guarantee Period, your Service will be cancelled, and all Content will be removed.
  • Each customer or account is eligible for only one Money-Back Guarantee. Eligibility is determined at our sole discretion.
Money-Back Guarantee Exclusions: The following are not covered by the Money-Back Guarantee and are non-refundable: domain registration and transfer fees, premium SSL certificates beyond basic SSL, dedicated IP addresses, priority support upgrades, third-party add-ons, professional email services (unless specifically included), website migration services, and backup restoration services beyond standard courtesy backups. The Money-Back Guarantee applies only to shared hosting plans and is not available for VPS, dedicated servers, or reseller hosting.

6. Billing, Payments, and Pricing

  • Fees are as displayed on the Website at the time of order.
  • Payments are processed through third-party gateways such as Stripe or PayPal. You authorize us to charge your selected payment method for all fees, including recurring subscription charges.
  • All fees are in USD unless otherwise stated and exclude applicable taxes, levies, or duties, which will be added where required.
  • Prices may change. Any changes will apply to new orders or renewals, with at least 30 days’ notice.
  • Failed payments may result in immediate suspension of Services and, if applicable, the imposition of late fees equal to 10% of the outstanding balance for each billing period during which the payment remains outstanding.
  • You are responsible for any currency conversion fees.

7. Refund Policy

All payments are non-refundable and non-creditable, except as provided in Section 5 (30-Day Money-Back Guarantee). Non-refundable items include, but are not limited to:
  • Subscription fees after the Money-Back Guarantee Period.
  • Set up fees, add-on fees, and overage charges.
  • Domain registration, renewal, or transfer fees (as these are incurred immediately with third-party registries and are non-refundable by industry standard).
  • Any payments made for upgraded or additional Services not covered by the Money-Back Guarantee.
No prorated refunds for partial Billing Cycles or early cancellation. Exceptions are made only where required by applicable law (e.g., mandatory cooling-off periods in certain jurisdictions).

8. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Services, you consent to our data practices as described in the Privacy Policy. We implement industry-standard security measures to protect your data, but we cannot guarantee absolute security against unauthorized access or breaches.

9. Auto-Renewal and Cancellation

Subscriptions automatically renew at the end of each Billing Cycle at the current rate unless cancelled.
Cancellation Process and Timeline:
  • For Hosting Services: Log in to your Account, navigate to Billing > Cancel Service, and follow the prompts. Alternatively, email support@hostgtpro.com with your account details and cancellation request. Submit cancellations at least five days before your next billing date to avoid charges for the next Billing Cycle.
  • Cancellation after the Money-Back Guarantee Period: Cancellation takes effect at the end of the current Billing Cycle. Services remain active until then, and no refunds are provided for unused time.
  • For Domain Services: Domains must be cancelled separately through your Account dashboard. Cancelling hosting does not automatically cancel domains. If you register a free domain with a hosting plan and cancel within the first year, a non-refundable domain fee equal to the standard domain name cost will be charged. Newly registered domains cannot be transferred to another registrar for 60 days per ICANN rules.
After cancellation, your Content may be deleted without recovery. You remain liable for outstanding fees.

10. Termination and Suspension by HostGTPro

We may suspend or terminate your Account and Services immediately, without notice or refund, for:
  • Violation of these Terms, Acceptable Use Policy, or law.
  • Non-payment or chargeback disputes. A chargeback fee of $20 to $50 will be charged for any disputed transactions, in addition to the original amount owed.
  • Abuse of resources, threats to network security, or complaints from third parties.
  • Fraudulent activity or misrepresentation.
Upon termination, your Content may be deleted without recovery. You remain liable for any outstanding fees.

11. Acceptable Use Policy

You agree not to use the Services for:
  • Illegal, harmful, or fraudulent activities (e.g., phishing, scams, hacking).
  • Distribution of malware, viruses, or spyware.
  • Unsolicited bulk email (spam), including violations of the CAN-SPAM Act.
  • Copyright infringement, trademark violation, or piracy (warez, torrents).
  • Adult/pornographic content, gambling, or hate speech.
  • Cryptocurrency mining without prior written approval.
  • Excessive CPU, bandwidth, or disk usage impacting other users (unlimited plans are subject to fair use; we monitor and may throttle or charge overages).
  • Proxy servers, IRC bots, or high-risk scripts without approval.
  • Any activity that damages our reputation or infrastructure.
A complete list of prohibited activities is available in our Acceptable Use Policy (AUP) on the HostGTPro Knowledgebase. Violations may result in immediate suspension or termination without refund. We cooperate with law enforcement and respond to valid DMCA notices.

12. Resource Usage and Fair Use

“Unlimited” plans are subject to reasonable use. Excessive resource usage is defined as:
  • Sustained CPU usage exceeding 25% of system resources for longer than 90 seconds.
  • Disproportionate RAM consumption.
  • Excessive disk I/O operations.
  • File counts (inodes) significantly above normal use.
Activities considered excessive include: resource-intensive scripts running continuously, file-sharing or download sites with heavy traffic, backup or storage services for external sites, cryptocurrency mining, video or audio streaming with high concurrent users, proxy services, VPN endpoints, automated bot traffic, or mass email sending beyond reasonable business use.
If you exceed fair use limits, we will contact you via email with details and optimization recommendations. You may be required to upgrade to a higher-tier plan (VPS or dedicated server) or optimize your usage. Continued excessive usage after warnings may result in temporary resource throttling, account migration, or suspension. Monitor your resource usage through your Account dashboard.

13. Domain Registration and Management

  • Domains are registered through accredited registrars.
  • You warrant ownership of, or the right to register, the requested domains.
  • You are responsible for renewals; we are not liable for expired domains.
  • Transfers follow ICANN rules; fees are non-refundable.

14. Backups and Data Responsibility

You are solely responsible for backing up your Content. We provide courtesy backups (daily or weekly, depending on plan) but do not guarantee their completeness, availability, or restoration. Data loss may occur due to hardware failure, hacking, or user error. We are not liable for data loss; please maintain off-site backups.
Accessing Courtesy Backups: Log into your Account, navigate to your hosting control panel (cPanel), and locate the Backup or Backup Manager section to view available backup dates.
To request restoration:
  • Submit a support ticket at support@hostgtpro.com with your account details, the specific backup date, and which files or databases you need restored.
  • Restoration requests are reviewed on a case-by-case basis and may take 24 to 48 hours or longer.
  • Restoration is not guaranteed and may not be possible in all circumstances due to technical limitations or data unavailability.

15. Intellectual Property

We own all rights to the Services, software, and branding. You grant us a worldwide, royalty-free license to host, cache, and display your Content as needed to provide Services. You retain ownership of your Content.

16. DMCA and Copyright Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, submit a notice to support@hostgtpro.com with:
  • (a) identification of the copyrighted work
  • (b) identification of the infringing material
  • (c) your contact information
  • (d) a statement of good faith belief
  • (e) a statement under penalty of perjury that the information is accurate
Repeat infringers will have their Accounts terminated.

17. Warranties and Disclaimers

Services are provided “AS IS” without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.

18. Limitation of Liability

To the maximum extent permitted by law, HostGTPro shall not be liable for indirect, incidental, consequential, special, or punitive damages (including lost profits or data), even if advised of the possibility. Total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless HostGTPro, its affiliates, officers, and employees from any claims, damages, or expenses arising from your Content, use of Services, or violation of these Terms.

20. Force Majeure

We are not liable for failures caused by events beyond our control (e.g., natural disasters, war, pandemics, or third-party outages).

21. Export Compliance

You agree to comply with all applicable export and import control laws and regulations. You represent that you are not located in, or a national of, any country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of laws. Any disputes shall be resolved exclusively in the state or federal courts located in Harris County, TX. For claims under $10,000, you agree to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, where permitted by law. The arbitration shall be conducted in Houston, TX, and the arbitrator’s decision shall be final and binding. The prevailing party in any dispute shall be entitled to recover reasonable attorneys’ fees and costs.
California Residents: Under California Civil Code Section 1789.3, California users are entitled to the following specific consumer rights notice: You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210. California law requires that we provide you with clear notice of automatic renewal terms. By subscribing to our Services, you authorize us to automatically renew your subscription and charge your payment method at the end of each billing cycle unless you cancel before the renewal date.
International Users: Our Services are operated from the United States. If you are accessing our Services from outside the United States, you consent to the transfer of your data to the United States. We make reasonable efforts to comply with applicable international data protection laws, including GDPR, where applicable. EU residents have additional rights regarding their personal data as outlined in our Privacy Policy.

23. Third-Party Services

We may integrate or recommend third-party services (e.g., payment processors, SSL providers, CDN services). Your use of third-party services is subject to their own terms and privacy policies. We are not responsible for the performance, security, or practices of third-party providers.

24. Miscellaneous

  • Entire agreement: These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and HostGTPro and supersede all prior understandings.
  • Severability: If any provision is found invalid or unenforceable, the remaining provisions will continue in full effect.
  • No waiver: Our failure to enforce any right or provision does not constitute a waiver unless acknowledged in writing.
  • Assignment: We may assign or transfer our rights and obligations under these Terms. You may not assign your rights without our prior written consent.
  • Notices: All legal notices must be sent to support@hostgtpro.com or our registered business address. Notices to you may be sent to the email address associated with your Account.
  • Survival: Sections relating to payment obligations, intellectual property, disclaimers, limitation of liability, and indemnification shall survive termination of these Terms.
  • Headings: Section headings are for convenience only and do not affect the interpretation of these Terms.

25. Service Credits and SLA

Service Level Agreement (SLA) terms and service credit eligibility vary by plan type. Service credits, if applicable to your plan, are calculated as follows:
  • Uptime Guarantee: We target 99.9% uptime for shared hosting services (excluding scheduled maintenance).
  • Service Credit Calculation: If uptime falls below the guaranteed threshold in a calendar month, you may be eligible for a service credit equal to 10% of your monthly hosting fee for each 1% or portion thereof below the guarantee (e.g., if uptime is 98.9%, that is 1.0% below the guarantee, resulting in a 10% credit; if uptime is 98.8%, that is 1.1% below the guarantee, resulting in a 20% credit).
  • Credit Request Process: To request a service credit, you must submit a support ticket within 30 days of the end of the calendar month in which the downtime occurred, with documentation of the outage.
  • Maximum Credit: Service credits shall not exceed 100% of one month’s hosting fees.
  • Exclusions: Service credits do not apply to downtime caused by scheduled maintenance (with advance notice), factors outside our control (force majeure, DDoS attacks, third-party failures), your violation of these Terms, or suspension/termination of your account.
  • Sole Remedy: Service credits are your sole and exclusive remedy for any service availability issues.
